As a side note, remember that some sex offenders have been assigned a risk level in an unconstitutional manner, according to certain federal courts. In other words, it is likely that the level 2 or level 3 sex offenders that are listed right now also include sex offenders who are yet to be granted a constitutional hearing in order to establish their risk level.

These discrepancies may be due to different methods of collecting, verifying, and updating the data and different definitions and criteria of who is considered a registered sex offender in New York.
