A judge can enter an arrest warrant based on sworn testimony or based upon a sworn complaint. However, the judge must find that probable cause exists to issue an active warrant for someone’s arrest. Probable cause is a reasonable belief that the person in question committed the alleged crime based upon the facts presented to the judge. The judge uses his wisdom to determine if the facts showed the result in probable cause. Once an arrest warrant has been signed, it is transferred to law enforcement agents for execution.
