To put it simply, an arrest warrant is a judicial order to the law enforcement agency to arrest and detain a person till he is presented before the court for a bail hearing.

An arrest warrant is issued in case of misdemeanors, felonies, and even when the accused fails to appear in court once bail has been granted. The police need a warrant to take a person into custody if he/she is a suspect in a criminal occurrence. To get the warrant, the Sheriff’s Department has to appeal to the local criminal court.

Al prevailing information regaling the case is offered to the sitting judge in an affidavit. The magistrate need only ensure that the evidence presented is sufficient for the state to file a case against the individual in question before signing the warrant.

An arrest order duly signed by the Chautauqua County, New York criminal court magistrate, is an active warrant. If the person against whom the warrant has been issued is not arrested for a while, the active warrant turns into an outstanding warrant.
